Welcome to Cherrish, operated by AJ Affiliates LTD (“we”, “our”, “us”).

By using our platform, you agree to these Terms and Conditions. Please read them carefully before creating an account or using our services.

Cherrish is a global platform.

Gifter accounts are restricted to users aged 18 or older.

Gifters remain anonymous by default but may optionally set a display name.

Profile holders must provide accurate details and are responsible for maintaining the security of their account.

Users are responsible for all activity under their accounts.

Profile holders may post text and optional images.

External links are permitted only to social platforms currently supported (Instagram, TikTok, YouTube, Twitch).

NSFW or adult material is strictly prohibited. Posting such material will result in account suspension.

All posts are published without prior review. Our team actively monitors and may remove inappropriate or unlawful posts at our discretion.

All payments are processed securely through Stripe.

Profile holders receive gift payouts weekly, every Sunday.

The platform charges a 30% commission on all gifter payments.

Refunds are not allowed except in cases of fraudulent card use, where refunds will be automatically issued.

Our commission fee is 30% of all gifter payments.

Profile holders are solely responsible for reporting and paying any taxes, duties, or levies applicable to gifts received.

Cherrish does not withhold taxes on behalf of profile holders unless legally required to do so.

By using Cherrish, profile holders acknowledge their responsibility to comply with local tax laws in their jurisdiction.

If a gifter's payment is subject to a chargeback, reversal, or dispute, Cherrish reserves the right to recover the equivalent amount from the profile holder's balance or future payouts.

In cases where fraudulent activity is detected, Cherrish may suspend the profile holder's account and withhold related funds at its discretion.

Profile holders agree to cooperate with Cherrish in resolving payment disputes, including providing evidence of legitimate activity if requested.

Profile holders retain ownership of the posts they share on Cherrish.

By sharing posts, profile holders grant Cherrish a perpetual, worldwide, irrevocable, royalty-free licence to use, display, reproduce, and promote their posts on and off the platform.

This licence allows us to feature posts in platform features, promotional materials, and marketing campaigns.

Users must not harass, defraud, impersonate others, or misuse the platform.

Profile holders and gifters must respect intellectual property laws.

Any breach of these rules may result in account suspension or termination.

Accounts may be suspended or terminated for misconduct or breach of these Terms.

We reserve the right to conduct periodic data cleaning of inactive accounts.

In cases of fraud, illegal activity, or policy violations, Cherrish may withhold or forfeit pending gift balances at its discretion.

Otherwise, legitimate balances will be settled in line with our normal payment schedule.

Cherrish provides services on an “as is” basis with no guarantees.

We are not responsible for disputes between profile holders and gifters.

We are not liable for downtime, errors, losses, or damages arising from the use of our platform.

We do not guarantee that profile holders will receive gifts through the platform.

We do not guarantee that gifters will receive responses, acknowledgements, or interactions from profile holders.

All participation in Cherrish is voluntary and at the user's own risk.

Cherrish will not be held liable or responsible for any failure or delay in performance caused by events outside of our reasonable control.

This includes but is not limited to natural disasters, acts of government, labour disputes, internet or hosting failures, service provider outages, payment processor disruptions, war, or civil unrest.

Use of our platform is also governed by our Privacy Policy, which explains how we collect, use, and safeguard your personal data.

We may update these Terms from time to time.

Continued use of Cherrish after updates constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United Kingdom.

All disputes will be handled exclusively in the courts of London, UK.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cherrish, superseding any prior agreements or understandings.
